SECTION 8 POLICY CHANGE NOTICE
Per HUD regulations if an owner fails to correct HQS deficiencies by
the time specified by the WPBHA, HUD requires the WPBHA to abate housing
assistance payment no later than the first month following the specified
correction period (including any extension) [24 CFR 985.3(f)].No retroactive
payments will be made to the owner for the period of the time the rent
was abated. Owner rents are not abated as a result of HQS failures that
are family’s responsibility.
Effective November 1, 2008, The West Palm Beach Housing Authority has
added the following to our current policy of Abatement:
A “no show” by either tenant or landlord for
the re-inspection after a failed inspection will be classified as a failure.
At its sole discretion, the WPBHA may grant an extension in lieu of abatement
for a period of time not to exceed [30] days. At the end of that time,
if the work is not completed [or substantially completed] the WPBHA will
begin the abatement.
Please be advised that either landlord or tenant or and adult must be
available on the inspection date to meet with our inspector. Failure to
do so will affect your payment.
